Expiry: Date to which a payment must be carried out. The term indicates also the amount of this payment.

Recording: Formality frequently accompanied by perception d´un right fixed or proportional. In general, l´enregistrement n´est not a condition of validity of the acts, but it gives unquestionable date to the informal agreements with l´égard of the thirds and can constitute, between the parts, a beginning of written proof.

Euribor: (or Tibeur) Rates to which the banks lend themselves l´argent in the zone euro. It is published each day in the variable term (1 month, 3 months, 6 months and 1 year). It replaces PIBOR, l´indice of the place of Paris. L´Euribor is used d´indice as reference for the loans tofluctuating rates suggested by certain banks.

FNAIM (National Federation of Real estate): Professional body to which adherent of real associations agents. The administrators of goods, the realtors and the experts promoters can also adhere to it.

Expenses Fresh purchasing/of change: Together consecutive expenses and rights to establishment of real sale. The expenses d´acquisition are made up for l´essentiel of various rights, taxes, taxes and fresh d´obtention of administrative parts, and for a less significant part by the fees of the notary. The expenses d´acquisition are reduced when it's well with housing use (approximately 9 to 13%), and full when it's real estate of professional use (approximately 20% or VAT). At the time of l´achat in the nine (building of less than 5 years), the sale is known as “without expenses of notary”, c´est-with-statement which the expenses are of order of 3%.

Guarantee: Contract by which a debtor or a third gives to his creditor or a third, a personal property belonging to him to guarantee l´exécution of the debt. The term “pledge” indicates also the thing on which safety is made up (see also “hypothecation”).

Guarantee d´achèvement: Subscribed by the manufacturer auprès d´un approved organization, it ensures l´achèvement l achetor of the construction or the refunding of the advanced sums.

Guarantee of delivery: Subscribed by the manufacturer within the framework d´une sale in future state achievement, it guarantees to l achetor it will be delivered at agreed date and prices. It is obligatory in the contracts of individual construction.

Guarantee of perfect completion: Subscribed by l entreprenor, it ensures purchaser against all the imperfections raised by purchaser during 1 year.


Decennial guarantee: Subscribed by the manufacturer, it ensures purchaser against all defects of construction during 10 years.

Guarantee of resale: Certain establishments include in their loans a guarantee resale: they guarantee that the resale price (moved by an event envisaged with the contract - divorce, vocational resettlement…) will be equivalent to the price d´achat, less the expenses of notary, or else they deal with the difference, within the limit generally of 200.000 F.

Mortgage: Guarantee allowing the bank to d´obtenir the resale although you acquired if you are in l incapacity to pay your monthly payments. The catch of mortgage causes expenses, taken by the notary. In the event of sale of the good before end of the loan contracted to buy this good, you will have to pay expenses of replevin.

Allowance d immobilisation: Sum paid by l acqueror during the signature of l´avant-contract of sale (compromised or promise) to title d´acompte on the selling price. Its amount is free, but it s´élève generally at 10% of the selling price of the good.

Index: It s tools of reference which is used for calculation of the rate of departure and revision of the loan atrevisable rate. The indices official and are published by the Bank of France. It s generally of the TIOP (Interbank Rate Offered in Paris) and of the TME (Average Rate of the State Loans ).

Index BT 01: National index of the building, official reference of price adjustment of construction which measures l´évolution of the cost of the factors of production in the building; published each month.

Index of the Cost of Construction (I.C.C.): It translates evolution of the prices in the real sector. It is used as reference for l indexation of the monthly payments of certain formulas of loans and for the revision of the rents.
